Please read these Terms of Service carefully before using FaceLive. By accessing or using our services, you agree to be bound by these Terms.
1 Acceptance of Terms
By downloading, installing, or using the FaceLive mobile application or any FaceLive web services (collectively, the "Services"), you acknowledge that you have read, understood, and agree to be bound by these Terms of Service ("Terms") and our Privacy Policy. If you do not agree to these Terms, do not use the Services.
2 Description of Services
FaceLive provides a platform for verified digital identity, including:
- Face recognition and liveness detection for identity verification
- Aadhaar-based identity verification and document scanning
- Business directory services with information on 29M+ GST-registered businesses in India
- Organizational access control and visitor management tools
- Cloud synchronization of identity profiles and recognition models
We reserve the right to modify, suspend, or discontinue any part of the Services at any time with reasonable notice.
3 Account Registration & Eligibility
To access most features of FaceLive, you must create an account. You agree to:
- Provide accurate, current, and complete registration information
- Maintain the security of your account credentials
- Notify us immediately of any unauthorized use of your account
- Be at least 13 years of age to use the Services
You are solely responsible for all activity that occurs under your account. We reserve the right to suspend or terminate accounts that violate these Terms.
4 Biometric Data & Consent
FaceLive collects and processes biometric data (facial images and derived mathematical embeddings) as part of its core identity verification service. By using these features, you explicitly consent to:
- The capture and processing of your facial imagery for identity verification
- Storage of your facial embeddings on secure servers and/or your device
- Use of biometric data solely for the purposes described in our Privacy Policy
You may not enroll the biometric data of any other person without their informed, explicit consent. Doing so is a violation of these Terms and may constitute a criminal offence under applicable law.
You have the right to withdraw consent and request deletion of your biometric data at any time by contacting support@facelive.app.
5 Acceptable Use
You agree not to use the Services to:
- Violate any applicable law or regulation
- Harass, abuse, or harm any individual
- Upload, transmit, or distribute child sexual abuse material (CSAM) or any illegal content
- Enroll or verify individuals without their knowledge and consent
- Attempt to reverse-engineer, decompile, or extract facial recognition models
- Use automated scripts or bots to scrape the Business Directory at scale
- Impersonate another person or create fraudulent profiles
- Interfere with or disrupt the integrity or performance of the Services
Violations may result in immediate account termination and may be reported to law enforcement.
6 Data & Privacy
Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Services, you consent to data processing as described therein.
7 Intellectual Property
All content, software, models, and technology comprising the Services are the exclusive property of FaceLive (Mark8) or its licensors. You are granted a limited, non-exclusive, non-transferable, revocable licence to use the Services for personal or organisational use in accordance with these Terms.
You may not copy, modify, distribute, sell, or lease any part of the Services, nor may you reverse-engineer or attempt to extract source code, except as permitted by applicable law.
8 Business Directory Data
The FaceLive Business Directory provides public profile pages for GST-registered businesses in India. This information is sourced from the GSTN public portal and is provided for informational purposes only.
- We do not guarantee the accuracy, completeness, or currency of any business listing
- Bulk scraping, automated downloading, or systematic extraction of directory data is prohibited
- Business owners may contact support@facelive.app to request corrections or removal of their listing
9 Disclaimers & Limitation of Liability
The Services are provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to merchantability, fitness for a particular purpose, or non-infringement.
To the maximum extent permitted by applicable law, FaceLive shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Services, even if we have been advised of the possibility of such damages.
Face recognition technology is not infallible. FaceLive should not be used as the sole means of access control in life-safety or high-security environments.
10 Termination
We may suspend or terminate your access to the Services at any time, with or without cause, and with or without notice, if we believe you have violated these Terms or if required by law. Upon termination, your right to use the Services will immediately cease.
You may terminate your account at any time by contacting support@facelive.app. Account deletion requests are processed within 30 days.
11 Governing Law
These Terms shall be governed by and construed in accordance with the laws of India, without regard to conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts in Bengaluru, Karnataka, India.
12 Changes to Terms
We reserve the right to update these Terms at any time. Material changes will be communicated via email or prominent notice within the application. Your continued use of the Services after such changes constitutes acceptance of the revised Terms.
